Shops and Establishments Act (State Specific)
The Shops and Establishments Act is a state-specific labour law that regulates working conditions in shops, offices, commercial establishments, restaurants, hotels and other covered workplaces. It generally deals with business registration, working hours, weekly holidays, leave entitlement, overtime, wage records, employment conditions and workplace welfare. Since each state has its own Act and Rules, the exact requirements, forms, registration procedures and compliance timelines may differ depending on the location of the establishment.
Employers must follow the provisions applicable in their state, maintain the required employee and attendance records, display statutory notices and submit prescribed information to the relevant authority. Proper compliance helps businesses protect employee rights, maintain transparent workplace practices and reduce the risk of notices or penalties. For example, establishments in Gujarat are governed by the Gujarat Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2019 and its Rules, 2020.
